i'm elizabeth cook. paul sa- 's going to be so hot tom . this is kpix 5 news. good evening, i'm ken. >> and i'm elizabeth cook. paul says it's going to be so hot tomorrow, there's a first heat advisory of the year. paul. >> yeah. this is early for that. tichically we get this later on in the month of mae or june, but right now we're talking about highs well into the 90s perhaps even right on san francisco bay. these are record highs for tomorrow, 92 san jose, santa rosa 91, san francisco 86, oakland 84. i'm confident each of those will be broken tomorrow. we may even get close to 90 in downtown san francisco so a heat advisory has been issued by the national weather service for all those record highs likely to be broken, big change, too, at the coast. you will be in the 80s tomorrow
1:40 am
running about 15 to 25 degrees above average, and that fire weather alert, the red flag warning for extreme fire danger, that has been extended until lunchtime tomorrow for north bay hills and east bay hills. wait till you see how chilly we get in the extended forecast. that's coming up in a few minutes. >> all right. paul, thank you. breaking news a wild fire in river side county community. exploded across nearly 3 thousand acres but fire crews are making progress. the summit fire is 35% contained. crews are battling 30 mile per hour winds, and they're expected to get even stronger in the next couple hours. one home has already been destroyed. hundreds more are evacuated and one firefighter has been hurt. back up here in california, the early fire season off to a blazing start, as well. three new fires today. the largest the 125-acre yellow fire in sonoma county. it badly damaged one home.
1:41 am
the good news is no other homes are in its path right now. full containment is expected some time tomorrow. >> our field conditions is ahead of normal. our fire activitity is ahead of normal. our staffing is also ahead of jor mall. we staffed additional engines. we staffed additional dozers. we staffed additional hand crews. there's a lot of tiff tiffing going on tonight. it has a lot to do with this. an eye sore that the city demands be cleaned up once and for all. the huge junk yard is right in the middle of richmond, and wait till you hear who kristen ayers says got the nasty note. >> below the bart tracks is a fenced in eye sore that has been a nuisance, some neighbors say for more than two decades. >> it's like a junk yard in the middle of a residential area, and it's been like that for a
1:42 am
long time. >> a patchwork quilt of beat-up cars and industrial equipment. neighbors have been complaining about it since the 90s and surprisingly the man who's been linked to the lot is richmond city councilman who has vowed to fight. >> got to walk the walk along with the talk. >> he may have no choice but to walk the walk now. the city prosecutor ordered him to clean up the mess in a harshly-worded 28-page letter calling the conditions unlawful, hazardous, unsafe and blieted, but he claims he's a victim of a political witch hunt by city council members who disagree with his policies. >> core can i has got problems, and they're all of his own making. when you're on the city council you're supposed to be an inspiration to people. you're supposed to set an example. >> i reached out to councilman for this story. he told me he'd be unavailable. the city planned another

inspection for his property tomorrow. >> and koun o councilman told kristen this isn't the first time the city has gone after about a nuisance property. first it was bad bolts. now, something else on the new bay bridge needs to be looked at. you have to wonder will this thing really open up on labor day? owe vasquez is standing by right now to tell us. joe, what is the problem now. >> the welds in question are at the bottom of the tower of the new bay bridge. each weld more than 30 feet long attaches the base of the tower to huge steel plaits just above the water line. they're supposed to protect the bridge in the event of a major earthquake but now the sacramento bee reports 20 of those welds are defective and that caltrans engineers know about them, in fact, have been fixing them for months now. the revelations about the welds came late this afternoon after
1:44 am
bay bridge officials tried to put to rest concerns about the other issue. 33 of these huge bolts broke when they were twisted too tightly. 192 more bolts the exact same size are being checked out. >> we have done a visual inspection of similar rods elsewhere on the span. they have not shown any signs of problems. >> now, there's concern for even more bolts, about 2400 of them of a smaller variety begging the question should they have just bought a different kind of bolt in the first place. >> looking back with hindsight, i think looking at different sorts of fasteners in some of these applications might have made sense. there are other kinds of fasteners that are a little bit sturdier when it comes to this problem. >> all right. as for the welds, the bay bridge spoeksman released a statement today that essentially said this. we're talking about 20 welds out of millions. they say it will not be a safety factor, a factor and they do not believe it will delay the opening of the bridge.
1:45 am
>> we'll wait to see what they say officially. joe vas ke. thanks, joe. uncertainty now the welds has put fund raising for that party on hold for the time being. the bay bridge alliance has pledges for about half of what it needs to throw a two-day party. the alliance says if a solution is found soon they'll start asking for money again. streets all over the bay area were packed today from san francisco to oakland, the peninsula and san jose. doe shows us tens of thousands of people spent part of may day demanding for rights for immigrants. >> another year, another may day march or is it. >> how do you know you're not wasting your time here. >> look around you. >> police say 10,000 people walked a three-mile route from east san jose to city hal, people like ana gonzales who's no longer afraid to tell the world she's undocumented.
1:46 am
>> are you afraid they're going to come after you if this interview airs. >> no, i'm not because i'm speaking for the people, not just for myself. >> san jose's march has into a celebration of culture, labor and faith now with a strong focus of immigration reform. the common theme, humanizing the debate by sharing stories like high school students who came to the u.s. as infants but now qualify for financial aid for college through the california dream act. >> we need an immigration reform today. we need it now so that dozens of families like me, millions of students like me can make their dreams come true. >> the other thing, keeping pressure on congress by writing, organizing, meeting and voting. >> if we all come together as a community and spend thousands and thousands of these, that will open them up. >> you cannot walk away from this place without signing something, without putting your name to a list so that you can be contacted because when we need you, we need you now. amen. >> amen.
1:47 am
>> and this was just as much of about flexing their political muscles. when you take faith and labor together we're talking about 150,000 plus highly-organized members here in san jose. they plan on using that political clout to pressure the house and senate to take up immigration reform this summer. live in san jose, kip doe, kpix 5. . san jose was pretty calm but may day in seattle as you can see here got out of hand. protesters, many of them anarchists threw pipes, fireworks and rocks at police. it got so bad police had to use flash grenades. at least 13 people were arrested. we have been reporting on the business investments involving members of a bay area church. here's linda yee with more. >> we reported on the department of corporation's desist and refrain ortd filed against michael parker and pastor lacy hawkins of the jen assembly church. they were accused by the state
1:48 am
of violating securities laws and soliciting investments from xhurj church members. we would like to point out the church was not named in the state's order, and there are no allegations against the church in the order. we also said the church is under criminal investigation. we twoont clarify that sources tell us that the investigation is limited to parker and hawkins, not the church. the attorney jen general's office will neither confirm nor te nigh that. we'd also like to clarify something we said about pastor hawkins. we reported the decision of the judge upholding the state's desist order banning further investment sales was a ruling against both parker and hawkins because hawkins failed to request a hearing in time. the judge only ruled against parker; however, according to the department of cooperations, the original order against hau wince stands. we also want to know the judge's

different kinds of lich sticks and glosses, and they found levels of nine metals in them, all of them containing led. >> it had like 35 different colors. >> lori is like many women. >> i use lipstick and then i'll put lip glass over it just for a little extra. >> where lipstick is their lifesaver or is it. >> do you wear lipstick? does it surprise you? you're still smiling with this news. >> it doesn't surprise me for sure. everything that weir doing these days is bad for us. >> i take it your favorite color is pink. >> yeah. >> researchers sate's not the color you wear or brand you's a potential health concern. it's how often you use it and ingest it. heavy usage is considered more than a dozen times a day of lipstick or lip glosses. >> probably use lipstick, like, 20 times a day. >> we definitely need to look at this more seriously. >> dr. katherine, professor of environmental health sciences at uc berkeley conducted the study and says high use could result

powder. this happened just hours after photos of the bombing suspects were shown on television. the backpack was recovered at a landfill. and a strange new detail in all of this. the man who was carjacked by the tsarnaev brothers just before the shootout with police says the younger brother only asked him one question while his older brother made threats. he wanted to know how much the guy paid for the mer say dees suv they were riding in. well, flashing lights, blaring siren, sinking feeling in the pit of your stomach. oh, yeah, most of us have been there before. we wanted to find out what are your rights when you get pulled over for a traffic ticket. i took a drive to find out what you can and can't do. >> it can happen to the best of us. >> i've been pulled over for speegd. i was 18. i just got my driver's license. >> i've been pulled over for a seat belt. >> i was rushing to pick up my daughter. >> i'm sorry i didn't know. >> and i got a ticket.
1:56 am
a big one. >> every year about one in ten of us will get pulled over. half those stops will result in a ticket. >> traffic stops are designed to prevent the loss of life. prevent injury and protect property. >> so if you get stopped, here's how to protect your rights, don't speculate. >> ma'am, do you know why i stopped you. >> no. that's not for you to decide. that's for them to tell you why they've stopped you. >> hello, officer, you know normally if you give them your driver's license, your registration, and your insurance, they're probably not going to want to search your car unless you give them reasonable suspicion and something else called probable cause. >> probable cause is more than a hunch. probable cause is more than they don't like the way you look. >> you can't talk or text while you drive. that's the law, but if you're pulled over, you can use your smart phone to record your conversation with the police officer.
1:57 am
well, california has some pretty specific laws against secretly recording a conversation so make sure you get permission both before and after you hit record. >> officer, i want to make a recording of this to make sure there are no misunderstandings later about what happened between us. >> if they say no. >> it rarely makes sense to argue with the police officer. >> or in the case of lease witherspoon, disobey instructions to stay in the car. finally, a police officer cannot arrest you if you give him the finger or cuss at you, but we don't recommend that. >> a lady doesn't do that. yeah. here's the deal on that. the content of your speech is protected by the first amendment, but your conduct is not. think about that. if you cuss up a storm or get in the officer's face, your conduct could on strict the officer from doing his job, and that can land you in hot wanter.
